Terms and Conditions ("T&C")

Welcome to Joya:Connect Beyond borders. These Terms and Conditions (“T&C”) constitute a legally binding agreement between you and FUNLAB TECHNOLOGY LIMITED (collectively, “we,” “us,” or “our”). Use of our Services is also governed by our PRIVACY POLICY.
To use Joya, you must read and agree to these T&C . Please read each clause carefully, especially those involving waiver or limitation of liability, jurisdiction, applicable law, and Separate Terms. Clauses that limit liability or affect your major rights may be highlighted.
You may only use the services if you have read, understood, and accepted all Terms. Use of the services (expressly or impliedly) constitutes your acceptance. These Terms become legally binding upon acceptance.
Joya solely provides services to adults who have attained the age of 18 and possess full capacity for civil conduct, and shall not render any services to minors. If you are under the age of 18, you shall immediately cease all use of the Joya.
If you do not agree to these T&C, you may not access our Services.
1. Right to Use the Services
We grant you a personal, non-exclusive, non-transferable, and limited license to use Joya for your non-commercial, entertainment purposes.
- Ownership: All rights, title, and interest in the Services (including but not limited to AI algorithms, UI design, 3D Emojis, and "No Boundary Land" concepts) remain our exclusive property.
- Limitations: You may not copy, modify, or reverse-engineer any part of the Services unless expressly permitted by law.
2. AI-Powered Services and Content Generation
Joya integrates generative AI technologies (including Smart Inspiration, AI Translation, and Chat Assistance).
AI Assistance: You acknowledge that AI-generated suggestions are for inspiration purposes only. Joya does not guarantee the accuracy, appropriateness, or uniqueness of AI-generated text.Given the technical characteristics of large language models and artificial intelligence, Joya is random in nature and cannot be guaranteed to be unique. Accordingly, you acknowledge and agree that we may deliver identical or similar generated content to different Users, and may produce different generated results in response to the same content uploaded to the Joya.
User Responsibility: If the information you submit, including images and other content, contains any third party’s personal information or intellectual property rights, you shall duly obtain legitimate authorization from the relevant third party prior to providing such information.You remain solely responsible for any content you choose to post or send, even if it was generated or modified by our AI tools.
AI Ethics: You agree not to use Joya’s AI tools to generate hate speech, harassment, or any content that violates our Code of Conduct.
3. User Contributions & AI License
Joya allows you to create and share "User Contributions" (e.g., posts, photos, and chat text).
User Contributions:During your use of the AI services of Joya, you may submit images to Joya (collectively referred to as the “Input”) and obtain content generated by Joya in response to such Input based thereon (collectively referred to as the “Output”). You shall be solely responsible for all content submitted by you, including without limitation ensuring that such content complies with all applicable laws and the provisions of these Terms. You hereby represent and warrant that you hold all right, licenses and authorizations necessary to provide the Input to our Services.
Ownership of UserContributions: As between you and Joya, and to the extent permitted by applicable law, you retain your ownership rights in Input and own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output. If the Input and/or Output contains any content in which Joya owns intellectual property rights or other legitimate legal interests, we shall retain all corresponding rights in such Input and/or Output, and the title and ownership thereof shall not be altered by reason of its inclusion in the Output.
License Grant: By uploading or contributing the User Contributions, you ("licensors") grant to Joya ("licensee"), an irrevocable, non-exclusive, perpetual, transferable, assignable, worldwide, sublicensable, royalty-free license to use, host, store, reproduce, modify, create derivative works, publicly perform, publicly display, or otherwise transmit and communicate the User Contributions, or any portion of it, in any manner or form and in any medium or forum, whether now known or later devised, without notice, extra fee or attribution of any kind to you or any third party. You also grant to all other users who can access and use your User Contributions in Joya services the right to use, copy, modify, display, perform, create derivative works from, and otherwise communicate and distribute your User Contributions on or through the relevant Joya services without further notice, attribution, or compensation to you.(including optimizing AI-assisted features).
Moral Rights: You waive any moral rights regarding our use of your contributions to the extent permitted by law.
4. Code of Conduct
4.1 Unless otherwise agreed upon with Joya, you agree that the services under the Terms are only for your personal, non-commercial use.
4.2 You shall use services in a manner defined or approved by Joya. The rights available to you under the Terms shall not be transferable.
4.3 You shall not use any plug-in, add-on or third-party tool not authorized by Joya to interfere with, destroy, modify, or exert other influence on the services under the Terms.
4.4 When you use Joya services, you promise to abide by the local laws and regulations, and you shall not use the service to engage in illegal activity.
4.5 To keep Joya-No Boundary Land for everyone, you agree NOT to:
- Post content that is sexually explicit, violent, abusive, or racially offensive.
- Use the Services for commercial solicitation or "spamming."
- Harass or stalk other users or our employees.
- Use bots, hacks, or unauthorized third-party software to interfere with the Services.
- Impersonation: Pretending to be someone else or using AI to create deceptive "deepfake" identities is strictly prohibited.
4.6 If Joya has reason to believe that your conduct is or may be in violation of the aforementioned, Joya may, at its sole discretion, suspend or terminate services without a prior notice, and pursue legal actions. If there are special laws and regulations in the area where you are located, such laws and regulations shall prevail.
4.7 If Joya discovers or is informed that the information you posted or published is in violation of the Terms or the laws, Joya has the right to decide at its sole discretion and take technical measures to delete, block or disconnect relevant links to the information. Additionally, Joya has the right to take measures as appropriate, including but not limited to suspending or terminating services, restricting, suspending or terminating your account, and you shall bear full responsibility solely (including but not limited to property damages, reputational damage, legal fees, attorney fees, notarization fees, transportation fees, and other reasonable expenses).
4.8 You shall refrain from involving Joya in any political or public incident when you use any service hereunder; otherwise Joya has the right to suspend or terminate such service provided to you.
5. Purchases and Virtual Items
We may offer "Virtual Items" (e.g., coins, gift items) for purchase with "real world" money.
You can purchase Virtual Items through payment channels available to you on the Site. The price for purchasing Virtual Items is solely determined by Joya or the Publishers and will be displayed on the Site at the point of purchase. We can change the prices at any time and you understand that we do not provide any price protection or refund in case of price reduction. The currency applicable to your payment may depend on various factors (e.g., the jurisdiction where you make the purchase).
- No Monetary Value: Virtual Items is of no monetary value and cannot be redeemed or exchanged for cash, cash equivalent, legal lender, legal currency, or any other property..
- When you provide payment information to us or to one of our payment processors, you represent to Joya that you are the authorized user of the card or account associated with that payment, and you authorize us to charge your credit card or to process your payment with the chosen third-party payment processor for any purchase or other fees incurred by you.
- You agree that you will not use IP proxying or other methods to disguise the place of your residence, whether to circumvent geographical restrictions on game content, to order or purchase items at prices not applicable to your location, or for any other purpose. Failure to do so means Joya may terminate your access to your account.
- No Refunds:ALL PURCHASES ARE FINAL. You acknowledge that the provision of Virtual Items for use in the Services is a process that commences immediately upon purchase and that you forfeit your right of cancellation once the process has commenced.Under no circumstances will refunds be provided for Virtual Items, except as required by local law.
- As the account holder, you are responsible for all charges incurred, including applicable taxes, and all orders or purchases made by you or anyone else using your account, including your family members or friends. If you cancel your account, Joya reserves the right to collect fees, surcharges or costs incurred before cancellation. Any delinquent or unpaid accounts must be settled before Joya will allow you to register again.
- Forfeiture: If your account is terminated for a breach of these T&C, you forfeit all unused Virtual Items without compensation.
- Within the scope prescribed by law, we provide corresponding refund policies:
- General Principle: ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. Except as expressly required by applicable local laws, any paid service fees, processed transactions, and unused services or in-app Credits inside Joya are strictly non-refundable and cannot be exchanged for cash or other monetary value.
- Apple App Store Purchases: Refunds for purchases made via Apple ID are managed exclusively by Apple. Joya cannot process or intervene in these requests. To request a refund, please follow the official App Store procedure:
- Open your iOS device settings and tap your Apple ID profile;
- Go to "Subscriptions" or "Purchase History";
- Locate your Joya transaction;
- Select "Report a Problem" to submit your request directly to Apple.
- Google Play Purchases: For refunds regarding Google Play transactions, you must provide your order number found in your Google Wallet or confirmation email. Upon receiving a valid cancellation notice under local statutory rights, Joya will coordinate with Google to process a full refund to your original payment method within 14 days, without handling fees.
6. Accounts and Security
- provide registration information: If the information you provide during the Joya account registration process is inaccurate, untrue, or contains illegal or harmful information, Joya has the right to deny your registration request and terminate Joya services provided to you. If you obtained an account by providing false information, or your registration information contains illegal or harmful information, Joya has the right to notify you to make corrections within a specified period, suspend or revoke your account accordingly. If you have obtained an account by using the identity of a third party without that party's authorization, including an affiliate or celebrity, Joya has the right to terminate the account and report your conduct to the local government or other authorities.
- Responsibility: You shall be fully responsible for the safekeeping of your Joya account and password, as well as all acts conducted through the use of such account and password. The sale, transfer, lending or sharing of your Joya account or password to any third party is strictly prohibited. In the event that your Joya account or password is improperly accessed or unlawfully used by others due to your negligent safekeeping or any third-party conduct, resulting in damages to you, Joya or any third party, you shall bear full liability therefor.If you believe that the confidentiality of your account information may have been compromised, you must notify us via email【support@joyachat.com】. We may ask you to provide a valid personal identification consistent with your registration information.
- Account Deletion: You may delete your account at any time. Upon account deletion, all associated Virtual Items will be permanently forfeited without the right to refund or compensation.We reserve the right to delete accounts that are inactive for 180 days.
7. Communications & Monitoring
We do not pre-screen all user content, but we utilize technology (including AI-driven moderation) to monitor and record interactions to ensure community safety. By using the Services, you irrevocably consent to such monitoring. You have no expectation of privacy regarding public posts or chat text sent through the platform.
8. Third-Party Services
Joya may contain links to third-party services (e.g., Apple/Google payment gateways, SNS login). We are not responsible for the content or privacy practices of these third parties,Meanwhile, nothing herein shall be construed as Joya’s endorsement of or assent to any positions or views expressed in the content of such web links.
9. Disclaimer of Warranties
9.1 You understand and agree that when you use the services, the services may be disrupted due to force majeure or other risks. For the purposes of the Terms, "force majeure" refers to an event that cannot be foreseen, overcome or avoided and has material effects on a party or both parties hereto, including but not limited to natural disasters, e.g. flood, earthquake, epidemic and storm, and social incidents, e.g. war, riot, government action, etc. When such event occurs, Joya will make its best efforts to cooperate first with the relevant organizations to make repairs in a timely manner, but Joya shall be exempt from any losses caused to you by such event to the extent as permitted by law.
9.2 THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. You understand that generative AI may occasionally produce content that is unexpected or unintended. While we employ moderation tools, Joya does not guarantee that the Services will be uninterrupted, error-free, or that AI-generated content will meet your expectations.
10. Limitation of Liability
THIS SECTION LIMITS WHAT YOU CAN RECOVER FROM FUNLAB TECHNOLOGY LIMITED IN A DISPUTE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW THE COMPANY PARTY WILL NOT BE LIABLE IN ANY WAY FOR ANY:
(1) LOSS OF PROFITS
(2) LOST REVENUE
(3) LOST SAVINGS
(4) LOSS OF DATA
(5) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
Notwithstanding the foregoing, some countries, states, provinces or other jurisdictions do not allow the exclusion of certain warranties, or the limitation of liability as stated above, so the above terms may not apply to you. Instead, in such jurisdictions, the foregoing exclusions and limitations will apply to the maximum extent permitted by the laws of such jurisdictions. Also, you may have additional legal rights in your jurisdiction, and the Terms will not prejudice such rights that you may have as a consumer of the services.

12. Governing Law
12.1 THESE TERMS OF SERVICE SHALL BE GOVERNED BY THE LAWS OF HONG KONG SPECIAL ADMINISTRATIVE REGION AND THE GENERAL INTERNATIONAL BUSINESS PRACTICES AND / OR INDUSTRY PRACTICES SHALL BE REFERRED TO WHERE THERE ARE NO APPLICABLE LAWS OR REGULATIONS.
12.2 IN THE EVENT OF ANY DISPUTE BETWEEN YOU AND Joya, IT SHALL BE SETTLED FIRST THROUGH AMICABLE NEGOTIATION; IF SUCH NEGOTIATION FAILS, YOU AGREE TO SUBMIT THE DISPUTE TO HONG KONG INTERNATIONAL ARBITRATION CENTRE (HKIAC) FOR ARBITRATION. ARBITRATION SHALL BE MADE IN Chinese.
